VINYL FENCE LIFETIME WARRANTY
COVERAGE & DURATION
Boundary Fence & Railing Systems Inc. warrants to the original homeowner/current homeowner & consumer of our products, that our vinyl products line is free from any manufacturing defects such as flaking or fading due to normal use. If Boundary Fence & Railing Systems Inc. finds any such defect after an on site verification /inspection or inspection of the sample of the defective material, Boundary Fence & Railing Systems Inc. reserves the right to pay the amount of manufactured material. Boundary Fence & Railing Systems Inc. shall not be responsible or liable for any costs associated with the removal of the original vinyl product.
LIMITATIONS
Boundary Fence & Railing Systems Inc. warranties are valid only when 100% of the PVC fence material (except post caps) was purchased from one of its dealers. In other words this warranty will be void if Boundary Fence & Railing Systems Inc. material has been used along with any similar materials not produced by Boundary Fence & Railing Systems Inc.
This warranty does not provide protection against any defects or damages caused by any situation beyond normal exposure, including but not limited to the following. Compensation for normal & expected weathering: - placeNormal weathering shall be defined as exposure to ultra violet light and extremes of weather and atmospheric conditions that will cause any colored surface to experience changes within the weathering and color hold standards established in ASTM specification D-4726. This warranty does not apply to any vinyl product which has been altered by painting,
varnishing or any coating or cleaning solutions or any improper power washing over original manufacturers finish.
Improper handling and installation not in .conformance to Boundary Fence & Railing Systems Inc. specifications including the use of accessories that are not recommended for the installation that may cause injury and/or not within the BOCA construction code, damage from foreign objects, fire, food, earthquake, lightening, hail, tornado, hurricane or acts of God, Ground Movement, settling of the ground on which the fence is installed or any case which does not involve manufacturing defects in the product supplied by Boundary Fence & Railing Systems Inc.
Boundary Fence & Railing Systems Inc. may substitute any material under this warranty that is comparable in quality & price range if the product initially purchased has been discontinued or modified.
REPORTING AND RESOLVING DEFECTS
Any dispute or controversy arising among the parties hereto regarding any term, covenant or condition of this agreement or the breach thereof, shall, upon written demand of any party hereto, be submitted to and determined by arbitration before the American arbitration association, in New York, New York, in accordance with the rules of the association then in effect. Any award rendered shall be made by means of a written opinion explaining the arbitrator's reasons for the reward. The arbitrators may not amend or vary any provisions of this agreement. Judgments upon the award rendered by the arbitrators may be ordered in any court of competent jurisdictions, which court shall have the power to review such award for compliance with this agreement.
All questions concerning intention, validity and meaning of this agreement or relating to the rights and obligations of the parties with respect to its performance shall be construed and resolved in accordance with the laws of the state of placeStateNew York.
